TERMS OF SERVICE

These Terms of Service apply when you use amoracreative.com, buy a digital product from us, or engage us for coaching, consulting or design services.

Please read them before purchasing.

Amora Creative is run by Carolina Villaça Parker, based in Sydney, Australia, ABN: 20947790899. In these Terms, "we", "us" and "our" mean Amora Creative, and "you" means the person or business using our website or services.

By using our website, making a purchase or booking our services, you agree to these Terms and our Privacy Policy.

1. Our offerings

We offer:

- Digital products, such as The Soulful Brand Workbook, and other downloadable guides, templates and resources

- Coaching and consulting services, including Brand Resonance coaching, strategy sessions and brand consulting

- Free resources, such as the Brand Resonance Quiz and email content

Each product or service is described on its own page. We aim to keep these descriptions accurate and up to date.

2. Prices and payment

All prices are in Australian dollars (AUD) and include GST unless stated otherwise.

Payments for digital products are processed securely through MailerLite's checkout, powered by Stripe. We never see or store your full card details.

For coaching and consulting services, payment terms, including any deposits, instalments and due dates, are set out in your proposal, invoice or client agreement. If a payment is overdue, we may pause services until it is received.

We may change our prices at any time, but changes won't affect purchases you have already paid for.

3. Digital products

Once your payment is confirmed, you'll receive access to your digital product by email or download link. If it doesn't arrive within 24 hours, please check your spam folder and then contact us.

When you buy a digital product, you receive a personal, non-transferable licence to use it for your own personal or business use. You may not:

- share, resell, redistribute or give away the product or download links

- copy, adapt or republish the content, in whole or in part, as your own

- use the content to create a competing product or teaching material

If you'd like to use our materials with a team or in your own programs, please contact us about a licence.

4. Coaching and consulting services

The specific scope, deliverables, timeframes and fees for coaching and consulting work are set out in your proposal or client agreement. If there is any inconsistency between that agreement and these Terms, the client agreement applies.

Sessions are usually held online. Unless your agreement says otherwise:

- Please give at least [48 hours'] notice to reschedule a session.

- Sessions cancelled with less notice, or missed without notice, may be forfeited.

- If we need to reschedule, we'll give you as much notice as possible and offer a new time.

- Packages of sessions must be used within the timeframe stated in your agreement.

We keep what you share with us in coaching and consulting confidential, as described in our Privacy Policy, unless the law requires us to disclose it.

5. Refunds

We want you to be happy with your purchase. Because digital products are delivered instantly and can't be returned, we don't offer refunds if you simply change your mind.

Coaching and consulting services are non-refundable once delivered. Refunds for sessions or work not yet delivered are set out in your client agreement.

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits your rights under that law. If a product or service has a problem, such as a faulty file, a product that doesn't match its description, or a service not delivered with due care and skill, please contact us and we'll work with you to make it right, which may include a repair, replacement or refund.

6. Results and responsibility

Our coaching, consulting and digital products are designed to support your thinking, clarity and decision-making. Results depend on many things outside our control, including your own effort, circumstances and choices, so we can't guarantee any particular outcome, income or business result.

We are not a substitute for legal, financial, accounting, medical or psychological advice. Please seek qualified professional advice for those matters. You remain responsible for the decisions you make for yourself and your business.

7. Intellectual property

All content on our website and in our products and programs, including text, frameworks, workbooks, graphics, videos and our brand, belongs to Amora Creative or is used with permission. It is protected by copyright and other intellectual property laws.

For consulting and design work, ownership of the final deliverables is set out in your client agreement. Unless agreed otherwise, we keep ownership of our underlying methods, frameworks, templates and tools, and we may show completed work in our portfolio with your permission.

Anything you create using our workbooks or tools, such as your own vision, values or brand content, belongs to you.

8. Using our website

Please use our website lawfully and respectfully. You must not try to interfere with the site, access it without permission, or use it to send spam or harmful content.

Our website may link to other websites or tools. We aren't responsible for their content or practices.

We work to keep our website accurate and available, but we can't guarantee it will always be error-free or uninterrupted.

9. Limitation of liability

To the extent permitted by law, including the Australian Consumer Law:

- we are not liable for any indirect or consequential loss, such as lost profits, revenue or opportunities, arising from your use of our website, products or services

- where our liability can be limited, it is limited to supplying the product or service again, or refunding the amount you paid for it

10. Ending our work together

We may suspend or end your access to a product or service if you seriously breach these Terms, such as by sharing a product without permission or not paying for services. For coaching and consulting, the process for ending an engagement is set out in your client agreement.

11. Changes to these Terms

We may update these Terms from time to time. The latest version will always be on this page, with the date it was last updated. The Terms in place at the time of your purchase will apply to that purchase.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we agree to the jurisdiction of the courts of New South Wales.

If there's ever a concern, we'd love the chance to resolve it with you directly first, so please get in touch.
